2.- Application

Sales transactions between Portalam Consultoria y Comercial SL, called from now in this document "Portalam", and the buyer, called from now in this document "Customer", is exclusively governed by these Terms and Conditions of Sale.

If Customer does not accept these Terms and Conditions, he/she should refrain from purchasing Portalam products or services.

If the Customer access, uses,  performs a purchase or accepts a delivery from Casturalia, means that The Customer agrees explicitly to these Terms and Conditions.

These Terms and Conditions may be updated,  so the Customer should come back to this page regularly to check them.


3.- Privacy and data policy

According to Law 15/1999, 13th December, on the Protection of Personal Data (Act), Portalam advices the Customer about the existence of an automated file containing customer’s personal data provided to Casturalia and used under Portalam responsabilty. The goal of this file is to provide The Customer information about the products offered by  Casturalia and other  commercial activities such as sales, promotions, etc.

The Customer agrees to the inclusion of  any type of collected data (forms, orders, etc ) in the automated file.  During the process of data collection, the Customer will be informed of the mandatory or non-collection of such data, except for ordering. In that case,  data collection will not be considered voluntary and it will be necessary  to provide the identity, address and bank details for payment, in order to  formalize  the purchase order.

The Customer may exercise the rights recognized in the Law 15/1999, and in particular the rights of access, rectification, cancellation and the revocation of rights to transfer his/her personal data

The rights referred to in the preceding paragraph may be exercised by the Customer, by sending an email to the address contacto@casturalia.com.

By accepting these Terms and Conditions, The Customer expressly  agrees to the transfer of his/her personal data only to Portalam company group. Customer’s personal data will never be sold or transferred to other companies.


4.- Prices, charges and taxes

The currency used within prices is in Euros. VAT is included in these prices, but not the shipping costs. Shipping charges are  in customer charge and they are added to the order total amount.

Portalam reserves the right to change prices at any time. However, Portalam guarantees  to apply the current rates listed in Casturalia at ordering time if the purchase has been accepted.


5.- Sale completion

To place an order the customer must be at least 18 years old, and able  to buy and provide a valid shipping address

The Customer can only order through Casturalia online shop.Portalam does not accept orders from other communication channels..

By placing an order, The Customer makes an offer to purchase the products selected in accordance with these Terms and Conditions. Portalam may or may not accept the offer from The Customer.

If  Customer’s order is accepted, then Portalam will send an order confirmation via email with the order number. However, if the order is not accepted ,Portalam will contact The Customer via email or telephone and the order will be cancelled.

 

6.- Payment
 

Available payment methods are displayed in step "payment " within order form.

Only payments in Euros accepted. 

 

Bankwire

If payment is made by bank wire, the customer will receive a payment request via email. The order will not be reserved or shipped before receiving the payment confirmation at Portalam bank account. If the payment is not received within the following 7 working days after ordering, the order will be cancelled. 

 

 

Collect On Delivery (COD)

You can also make the payment when receiving the goods at home with COD mode. This option is only available for orders shipped to Peninsula, and it encreases by 3% management fee on the final amount of the order (goods plus shipping charges).
               
Portalam strongly recommends to have the exact amount when being delivered, because the carrier may not carry change.
               
This option is not available for shipping to European Union countries, Balear Islands, Canary Islands, Ceuta and Melilla.

7.- Shipping and delivery

Casturalia only ships to Europe.

To deliver the order, the Customer must provide:
- A valid shipping and delivery address with all the details such as floor, building, entry code, etc.
- A contact phone
                   
Shipping costs depend on the  weight, the volume and the destination. The exact amount will be displayed during the purchase process.       
   
Delivery deadline depends on the ordering country and it will be sent to The Customer by email. The delivery duration is in working days and the start date is after the order is ready for shipping and the payment is verified. However, Portalam is not responsible for delays due to major force. In case of delay, Portalam will try to deliver the order as soon as possible.           

Deliveries are made from Monday to Friday during working hours (9:00 to 18:00). If The Customer is not available at delivery time, the carrier will contact him/her in order to agree with a delivery date, time and  place.
   
If the delivery takes longer than expected, the carrier will be contacted for investigation purposes that might take several days (approximately 14 days). During this period, no cancellation or refunds are accepted.

Customer is requested to check the goods conditions at delivery time. If The Customer does not agree with the delivered merchandise, he/she must sign and write in the delivery sheet the anomalies found when receiving the order.

The Customer can track the order  using the information provided by email.


8.- Requests/claims and customer service

Customer Service is available in order to perform a request or a claim:

Requests will be processed during business hours (Madrid GMT):
From October to March: 9:00 to 14:00 and from 16:00 to 19:00
From April to September: from 9:00 to 14:00 and from 17:30. to 20:00


9.- Return policy and cancellation policy

If a product is not in the sanitary conditions needed to be eaten without risk to health, return is allowed. Return requests has to be notified within 7 working days after reception. Portalam will be in charge of the incurried expenses.

There will be no other reason to return any items, with special reference to the customers's subjective judgement such as  food taste, texture, etc.

In order to request a refund The  Customer must contact Casturalia within 7 working days from reception date, according to Spanish law 47/2002 (Ordenación del Comercio Minorista y el Usuario) . The contact must be through Casturalia Refunds and Returns section. For that:

1 .- On “My Account” home page, click on “History and order details “ (or similar) to display your orders
2 .- In the order containing the goods to be returned, click  on “Details”
3 .- In order details display, check the product you want to return.
4 .- In the “Quantity” box, type the number of this product  to return.
5 .- In the “Return Merchandise” box, type the reason for requesting the RMA.
6 .- Click on “Create a RMA sheet”.

The Customer will receive a confirmation email if the return is accepted. If accepted, all returns must be accompanied by the return sheet and invoice. Merchandise must be sent, expenses paid by The Customer, to the address on the confirmation email back within 7 working days from the confirmation email. If not received within this period, the return will be rejected.

The goods must be returned by registered and recorded mail or by a carrier with an insurance. This insurance will be necessary in case of damage or loss of goods by the carrier. In any case, any return costs are in customer charge.

According to these cancellation and refund terms, only products shipped with their original packaging, in good conditions and including the return sheet will be accepted. Products shipped by customer  poorly packed,  in bad conditions or  with damages will not be refunded.

If Portalam agrees with goods conditions, the refund will take place by bank wire and within 15 working days.


10.- Intellectual property

All  content on the site Casturalia, including text, still and animated images,  logos, icons, buttons, databases, programmes, commercial names, etc., is the exclusive property of Portalam or of third party owners who have authorized their inclusion in Casturalia and is protected by international copyright  and other intellectual property laws..

Under no circumstances, the rights should be used for  transfer, sale, alteration, exploitation, reproduction, distribution or  used for public communication without Portalam express permission or the relevant owners. All rights not expressly     granted are reserved.


11.- Applicable laws

The use of Casturalia shall be governed in all respects by the laws of Spain, without regard to choice of law provisions. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating toPortalam (including but not limited to the purchase of Casturaliaproducts) shall be in the state or federal courts located in Plasencia, Spain.


12.- Responsability

Portalam  is not responsible for non-execution of these conditions in case of  force major, in case Customer’’s fault or in case of  improper fulfillment of the obligations by any company outside Portalam.

Portalam and The Customer, based in Spain or elsewhere, are subject to the courts of Plasencia (Spain) if any dispute or disagreement is rised according to the  interpretation of these terms and conditions.

If any provision of this contract is found  invalid or unenforceable, the invalidity or unenforceability of the said provision shall not affect the other provisions of these terms and conditions and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect.


13.- Updates Of These Terms Of Use

Portalam reserves the right to amend this policy to adapt to new legislation and industry practices. In such cases, Portalam  will announce the updates on this page changes with reasonable notice before implementation.
